WHEREAS, on the 2nd day of May, 2016, the Holder of said Deed of Trust filed a Loan Modification Agreement of Deed of Trust by instrument recorded in the office of the aforesaid Chancery Clerk of Court in Mortgages & Deeds of Trust on Lands Book 812 at Page 208; and
WHEREAS, on the 7th day of October, 2011, Mortgage Electronic Registration Systems, Inc. , assigned said Deed of Trust unto Bank of America, N.A., successor by merger to BAC Home Loans Servicing, LP fka Countrywide Home Loans Servicing, LP, by instrument recorded in the office of the aforesaid Chancery Clerk in Mortgages & Deeds of Trust on Lands Book 732 at Page 618; and
WHEREAS, on the 29th day of June, 2017 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Deed of Trust Book 0834 at Page 424; and
WHEREAS, by Amended Order Granting Default Judgment and Final Judgment on the Pleadings, rendered in the matter styled Bank of America, N.A. vs. Machrell Antwine, et al., Cause No. 17-cv-145 of the Chancery Court of Leflore County, Mississippi, rendered on the 2nd day of May, 2018, said order grants a declaratory judgment confirming title to the subject property is held by Machrell Antwine, in fee simple; Reforms and revives Deed of Trust in Book 696 at Page 65, Assignment in Deed of Trust Book 732 at Page 618, Loan Modification Agreement in Deed of Trust Book 812 at Page 208, and Substitution of Trustee in Deed of Trust Book 834 at Page 424 to include the correct description of legal; Imposes an equitable lien against the interests of Machrell Antwine in favor of Plaintiff; Deed of Trust in Book 696 at Page 65 is a valid, perfected, and enforceable first lien. Order Granting Default Judgment and Final Judgment on the Pleadings appearing in the Leflore County Chancery Clerk’s land records in Deed Book 465 at Page 489 on May 11, 2018; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 20th day of June, 2018, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the South front entrance (or door) of the Leflore County Courthouse at Greenwood, Mississippi, for cash to the highest bidder, the following described land and property situated in Leflore County, Mississippi, to-wit:

THE LEFLORE COUNTY PROPERTY MAINTENANCE ORDINANCE
ORDINANCE NO.: 2018-1
EFFECTIVE FROM AND AFTER JULY 1, 2018
WHEREAS, pursuant to Miss. Code Annotated §19-3-40, the Board of Supervisors of Leflore County, State of Mississippi, desires to provide for the public health and safety of the citizens of Leflore County by reducing conditions that reduce property values, promote blight and deterioration, on public and private property, thereby creating and resulting in a public nuisance within Leflore County.
NOW, THEREFORE, be it Ordained and Enacted by the Board of Supervisors of Leflore County, State of Mississippi, State of Mississippi, as follows:
TITLE: This Ordinance and all Ordinances supplemental or amendatory hereto shall be known as The Property Maintenance Ordinance and may be cited as such and will be referred to herein as “this Ordinance.”
PURPOSE: The purpose of this Ordinance is to provide minimum standards for the prevention and suppression of disease and health risks associated with the accumulation of trash, junk, weeds, debris, refuse or any other condition that tends to harbor insects and attract vermin, cause traffic and safety hazards, cause visual blight, pose a threat of environmental contamination, interference with the use of enjoyment of other property owners, and depreciate property values, and therefore hereby declares said conditions, junk and debris to be public nuisances.
AUTHORITY: The following shall be authorized enforcement agents in the enforcement of this ordinance within the areas of Leflore County, Mississippi: Leflore County Ordinance Enforcement Officer, Leflore County Sheriff’s Department, the Mississippi Department of Health Department, Solid Waste Management District and their representatives/agents are hereby authorized to investigate violations and to perform all actions necessary for the enforcement and administration of this ordinance and will be referred to as “Enforcement Agents”.
DEFINITION: Property maintained in a condition so defective, unsightly, or in a state of such deterioration, disrepair or neglect that it causes a health, safety or fire hazard or a public nuisance to children or others such as:
a. The accumulation of dirt, litter, refuse, trash or debris in carports, parking areas, driveways, front yards, side yards, rear yards, vestibules, doorways of buildings, the adjoining sidewalk, or alley;
b. Storage of personal property (other than items designated for outdoor use) in front, exterior side, or rear yard areas visible to public view, including, but not limited to unregistered, inoperative or dismantled vehicles or vehicle parts, building materials not currently being used for the construction of improvements on the site, appliances, household furnishings or equipment, tools, machines, garbage cans, packing boxes, debris, rubbish, and broken or discarded furniture, equipment or toys;
c. Trees, weeds, grass, vines, brush, or other vegetation, which are growing or dead in excess of twelve (12) inches;
d. The accumulation of trash, junk, weeds, debris, refuse or any other condition that tends to harbor insects and attract vermin, cause traffic and safety hazards, cause visual blight, pose a threat of environmental contamination, interfere with the use of enjoyment of other property owners, and depreciate property values, and therefore hereby declares said conditions, junk and debris to be public nuisances;
ENFORCEMENT PROCEDURES: (1) The Leflore County Ordinance Enforcement Officer, Leflore County Sheriff’s Department serving in Leflore County, Mississippi, the Mississippi Department of Health, the Solid Waste Management District and their representatives/agents are hereby empowered to issue corrective written notices or citations to persons in violations of any of the provisions of the ordinance. Further, any citizen of Leflore County may file a sworn affidavit in the Justice Court of Leflore County to be taken against any party in violation of the ordinance.
(2) The Leflore County Ordinance Enforcement Officer or the Leflore County Sheriff’s Office of the county shall initiate an investigation for possible prosecution for a violation of this ordinance where the officer(s) has sufficient probable cause to believe this ordinance is being violated. (3) If the Leflore County Ordinance Enforcement Officer or the Leflore County Sheriff’s Office discovers a violation of this Ordinance, a corrective written notice in the form of a “Corrective Warning Citation”, attached hereto, may be issued to violators of this ordinance to correct an offense, in lieu of citation or arrest. The notice shall state the date and time issued, nature of offense committed, corrective measures to be taken and the date and time by which such corrections shall be made.
(4) Corrective written notice, in the form of a “Corrective Warning Citation”, may be issued to violators of this ordinance to correct an offense, in lieu of citation or arrest. The Corrective Warning Citation shall state the date and time issued, nature of offense committed, corrective measures to be taken and the date and time by which such corrections shall be made. The issuing authority for public inspections shall retain all such notices issued during normal office hours.
FAILURE TO COMPLY WITH CORRECTIVE WRITTEN NOTICE: Any person who has been served a corrective written notice in the form of a Corrective Warning Citation in accordance with the provisions of this ordinance, and who shall neglect, refuse or fail to fully comply with the corrective notices so ordered and/or within the time frame so ordered therein, shall be in violation of this ordinance. The Leflore County Ordinance Enforcement Officer or Leflore County Sheriff’s Office may issue to violators of this ordinance a citation to appear in the Justice Court of Leflore County, Mississippi on the next available court date correct for prosecution of the violation of this Ordinance.
PENALTIES, FINES AND REMEDIES: Upon the failure or refusal of an owner, occupant, agent or person in possession of the premises (who was the recipient(s) of the corrective written notice in the form of a Corrective Warning Citation) and the lessee to correct the violation and was later issued a “Written Citation” for violation of this Ordinance, upon conviction shall be guilty of a misdemeanor, and any conviction thereof shall be punishable by a fine of not more than $1,000.00 or by imprisonment in the county jail for not more than 90 days, or both such fine and imprisonment, or an Order to remove or correct the public nuisance by a date certain, to be determined by the Justice Court Judge.
OTHER REMEDIES: Any such action for mandatory or injunctive relief may be joined with an action to recover the penalties, costs and expenses provided in this Ordinance. In the event any legal action is necessary to enforce this Ordinance, the County may seek recovery of costs and expenses reasonably incurred to enforce the provisions of this Ordinance including, but not limited to, reasonable attorney's fees.
SEVERABILITY: Should any section, paragraph, sentence, clause, or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of said Ordinance shall not be affected thereby and shall remain in full force and effect.
