SUBSTITUTED TRUSTEE'S FORECLOSURE NOTICE
WHEREAS, on November 25, 2014, Isaiah Simon, Jr. and Chiquetta Simon executed a certain Deed of Trust to Mark S. Vemer, for the benefit of Bank of Commerce, which Deed of Trust is of record in the office of the Chancery Clerk of Leflore County, Mississippi in Deed of Trust Book 788, at page 471 ; and
WHEREAS, Bank of Commerce has heretofore substituted H. Donald Brock, Jr. as Trustee in place and in lieu of the present Trustee by instrument dated June 1, 2018, and recorded June 5, 2018, in Book 847 at page 602 of the office of the aforesaid Chancery Clerk; and
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due in accordance with the terms thereof, Bank of Commerce, the legal holder of said indebtedness requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees, and expenses of sale.
NOW, THEREFORE, I, H. Donald Brock, Jr., Substituted Trustee, in said Deed of Trust, will on the 9th day of July, 2018, between the hours of 11:00 a.m. and 4:00 p.m. offer for sale and sell at public auction for cash to the highest and best bidder at the South front door of the Leflore County Courthouse in the City of Greenwood, Mississippi, the following described property conveyed by said Deed of Trust, to-wit:
Lot 10 in Block 6 of the Wagner Southeast Addition to the City of Greenwood, Leflore County, Mississippi as same is shown on the map of said Addition in Plat Book 5 Page 2 of the Records of Maps of Leflore County, Mississippi.
I will sell and convey only such title as is vested in me as Substituted Trustee.

You have been made Respondents to the Petition filed in this Court by Darryl Wright, Administrator of the Estate of Nehemiah Darryl Wright, Deceased, seeking determination of heirship. The other Respondents to this Petition are Darryl Wright and Nia Wright, a son and a daughter of Nehemiah Darryl Wright, Deceased.
Take notice that a trial will be held in the above styled and numbered action to which you are a Respondent on Tuesday, the 21st day of August, 2018 at 9:30 o'clock a.m. at the Leflore County Courthouse, Greenwood, Mississippi.
The action against you is one described in Rule 81(d)(1) of the Mississippi Rules of Civil Procedure which is triable thirty (30) days after completion of service of process in any manner other than by publication, or thirty (30) days after the first publication where process is by publication.
Your response must be mailed or delivered to Petitioner's attorney, F. Ewin Henson III, P.O. Drawer 8230, Greenwood, Mississippi 38935-8230, not later than thirty (30) days after the 29th day of June, 2018, which is the date of the first publication of this Summons. If your response is not so mailed or delivered, a judgment by default may be entered against you for the relief demanded in the Amended Petition.
You must also file the original of your response with the Clerk of the Court within a reasonable time afterward.
