WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated June 30, 2006, executed by CATHERINE SMITH and HENRY SMITH, JR. conveying certain real property therein described to EMMETT JAMES HOUSE OR BILL R. MCLAUGHLIN, as Trustee, for REGIONS BANK D/B/A REGIONS MORTGAGE, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the office of the Chancery Clerk of Leflore County, Mississippi filed and recorded June 30, 2006, in Deed Book 651, Page 179; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to NewRez LLC d/b/a Shellpoint Mortgage Servicing; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on May 15, 2025 within the lawful hours of sale between 11:00AM and 4:00PM at the South Main Door of the Leflore County Courthouse, 310 West Market Street, Greenwood, MS 38930 proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Leflore County, Mississippi, to wit:
THAT CERTAIN TRACT OR PARCEL OF LAND DESCRIBED AS FOLLOWS: BEGINNING AT THE QUARTER SECTION CORNER BETWEEN SECTIONS 11 AND 12, IN TOWNSHIP 19 NORTH, RANGE 1 EAST, IN SAID COUNTY AND STATE, AND RUN SOUTHWARD ALONG THE SECTION LINE FOR A DISTANCE OF 485.1 FEET TO THE POINT OF BEGINNING OF THE TRACT OR PARCEL OF LAND HEREBY DESCRIBED; FROM SAID POINT OF BEGINNING RUN THENCE SOUTH 38 DEGREES 35` EAST TO THE NORTH EDGE OF GRENADA BOULEVARD FOR A DISTANCE OF 113.9 FEET; THENCE RUN NORTH 48 DEGREES 50` EAST ALONG THE NORTHERN BOUNDARY OF GRENADA BOULEVARD FOR A DISTANCE OF 116 FEET TO A POINT; THENCE RUN NORTH 38 DEGREES 35` WEST FOR THE DISTANCE OF 180 FEET TO A POINT; THENCE RUN SOUTH 48 DEGREES 50` WEST AND PARALLEL WITH THE NORTHERN BOUNDARY LINE OF GRENADA BOULEVARD FOR THE DISTANCE OF 116 FEET TO A POINT; RUN THENCE SOUTH 38 DEGREES 35` EAST FOR THE DISTANCE OF 66.1 FEET TO THE POINT OF BEGINNING, THUS ENCLOSING .48 ACRES OF LAND IN THE SOUTHEAST QUARTER OF SECTION 11 AND IN THE SOUTHWEST QUARTER OF SECTION 12, ALL IN TOWNSHIP 19 NORTH, RANGE 1 EAST IN SAID LEFLORE COUNTY, MISSISSIPPI.
PROPERTY ADDRESS: The street address of the property is believed to be 2305 GRENADA BLVD, GREENWOOD, MS 38930. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.
Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.
