A Greenwood man has filed a lawsuit against Leflore County seeking damages after he allegedly struck a tree while driving last year.
The lawsuit, which is one side of a legal argument, was filed last month in Leflore County Circuit Court by Mark Head, identified as living in Greenwood.
According to the lawsuit, Head alleges that on March 31, 2021, he was traveling on Money Road when a tree that he was unable to avoid fell into the road and he struck it. The suit does not detail which direction Head was driving or how the tree may have fallen.
Head also alleges that he suffered severe injuries and called for emergency assistance, but none came. The lawsuit accuses Leflore County of negligence and wantonness.
“Plaintiff was injured due to a dangerously maintained roadway and Defendant allowed said condition to be present without warning to the Plaintiff of the present danger,” the lawsuit said.
The lawsuit also accuses Leflore County of “creating and maintaining a known dangerous condition and failing to cure or warn invitee of said dangerous condition.”
Head is seeking damages, court fees and attorney fees. He is being represented by Jessica Lennard, an attorney with the Slocumb Law Firm’s Gulfport office.
The lawsuit does not name a specific individual as a defendant, only the county itself.
Leflore County has not filed a response, according to the case docket.
