WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated May 24, 2019, executed by ROBIN HUDSON and MARKETA WISE conveying certain real property therein described to BRAD MAURITZEN, as Trustee, for MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS BENEFICIARY, AS NOMINEE FOR ENVOY MORTGAGE, LTD, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the office of the Chancery Clerk of Leflore County, Mississippi filed and recorded May 30, 2019, in Deed Book 863, Page 607; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to Lakeview Loan Servicing, LLC.; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on March 12, 2024 within the lawful hours of sale between 11:00AM and 4:00PM at the south steps of the Courthouse proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Leflore County, Mississippi, to wit:

ENERGY SERVICES PERFORMANCE CONTRACT
Leflore County Board of Supervisors, Greenwood, Mississippi is seeking Qualification statements relating to Energy Services Companies (ESCOs) to provide energy conservation equipment and services under an Energy Services Performance Contract. ESCO qualifications will be submitted in accordance with Section 31-7-14 of the Mississippi Code, the Mississippi Development Authority—Energy and Natural Resources Division’s Policy and Procedures for Energy Performance Contracting and the Request for Qualifications.

On or about February 29th, 2024 the City of Greenwood will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of the Healthy Homes Production Grant Program (HHP). The Healthy Homes Production Program is authorized under Section 501 and Section 502 of the Housing and Urban Development Act of 1970 (12 U.S.C. §§ 1701z-1 and 1701z-2), and funding is provided by the Consolidated Appropriations Act, 2023 (Public Law 117-328, approved December 29, 2022). This program is administered under HUD’s Office of Lead Hazard Control and Healthy Homes (OLHCHH) for the following multi-year program/project: Greenwood Healthy Homes Production Grant (GHHP) for the following purpose:
GHHP seeks to improve the health outcomes of low-income (80% AMI and below) owner-occupant households in three census tracts (9507, 9508, and 9509) within the City limits of Greenwood, MS. Utilizing Healthy Housing Principles, the project team will assess a targeted 140 households, develop scopes for health hazard remediation, and complete home repairs at approximately 120 single-family homes. All homes where interventions takes place will be single-family residences. Typical activities that may take place at individual homes will include repairing leaking roofs, replacing broken windows and/or doors, remediating harmful substances such as lead-based paint or mold, removing trip hazards, repairing broken plumbing fixtures, repairing dangerous electrical, and improving unhealthy heating and air systems.
The City of Greenwood is requesting the release of $1,996,898.00 in HUD funds (matching fundings will be leveraged to result in a total project cost of $2,392,253.00)
The proposed hazard control activities to be funded under this/these program(s) is/are categorically excluded from the National Environmental Policy Act requirements, but subject to compliance with some of the environmental laws and authorities listed at § 58.5 of 24 CFR Part 58. In accordance with §58.15, a tiered review process has been structured, whereby some environmental laws and authorities have been reviewed and studied for the intended target area(s) listed above. Other applicable environmental laws and authorities will be complied with when individual projects are ripe for review. Specifically, the target area has/have been studied and compliance with the following laws and authorities has been achieved in this Tier 1 review: (Airport Hazards, Coastal Barriers Resources, Air Quality, Coastal Zone Management, Endangered Species Act, Explosive and Flammable Hazards, Farmlands Protection, Sole Source Aquifers, Wetlands Protection, Wild and Scenic Rivers Act, and Environmental Justice). Site-specific environmental reviews will include compliance with the following environmental laws and authorities for proposed projects funded under the program(s) listed above: (i.e., Flood Insurance, Floodplain Mitigation, Historic Preservation, Contamination and Toxic Substances, and Noise Abatement and Control). Should individual aggregate projects exceed the threshold for categorical exclusion detailed at §58.35(a), an Environmental Assessment will be completed and a separate Finding of No Significant Impact and Request for Release of Funds published. Copies of the compliance documentation worksheets are available at the address below.
An Environmental Review Record (ERR) that documents the environmental determinations for this project, and more fully describes the tiered review process cited above, is on file at Greenwood City Hall, Office of the Mayor, 101 W. Church St. Greenwood, MS and Project Director’s office at Delta DB 209 Main St. Greenwood, MS and may be examined or copied weekdays 8:30 a.m. to 5:00 p.m.. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Greenwood CAO Cynthia Stanciel at 101 W. Church St. Greenwood, MS or cstanciel@cityofgreenwood.org. All comments received by February 28th, 2024 will be considered by the City of Greenwood prior to authorizing submission of a Request for Release of Funds and Environmental Certification to HUD.
RELEASE OF FUNDS
The City of Greenwood certifies to HUD that Cynthia Stanciel in her official capacity as Chief Administrative Officer of the City of Greenwood consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Greenwood to utilize federal funds and implement the Program.
OBJECTIONS TO RELEASE OF FUNDS
HUD will consider objections to its release of funds and the City of Greenwood certification for a period of fifteen days following either the anticipated submission date (cited above) or HUD’s actual receipt of the request (whichever is later) only if the objections are on one of the following bases: (a) that the Certification was not executed by the Certifying Officer of the City of Greenwood; (b) the City of Greenwood has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the City of Greenwood has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
