The city of Greenwood has filed a complaint against a Grenada attorney representing Greenwood High School senior James Marshall in a $2 million lawsuit against the city, which also includes the Greenwood Public School District, Greenwood Mayor Sheriel Perkins, Police Chief Henry Harris and Police Officer Casey Wiggins.
The suit was filed in Leflore County Chancery Court. Grenada attorney Carlos Moore said the filing by City Attorney James Littleton is requesting the quashing of a subpoena on the personnel records of Wiggins.
Wiggins on Dec. 6 was assigned to school security at Greenwood High School. On that day, Wiggins and Marshall got into a scuffle and Wiggins twice pulled his service pistol on Marshall, who at the time was 17.
The officer, captured on school surveillance tapes, also briefly employed a choke hold on Marshall.
Wiggins has been reassigned from the school. He is awaiting a probable cause hearing in March in the case.
The city is also requesting the Chancery Court impose sanctions on Moore and asking for attorney fees in response to Moore's repeated legal filings in the case.
"They claim I'm harassing the city and causing embarrassment. The embarrassment was the action of one of their police officers," Moore said.
Moore said he filed a motion of contempt and a motion to compel the city to release Wiggins' complete personnel record and that's what prompted the city's action.
Littleton could not be reached for comment this morning.
Moore said he will file his response to the city's filing later today.
On Friday, Moore requested all Greenwood High School surveillance tapes.
A hearing on that matter will be held at 11 a.m. Feb. 16 by Chancery Judge Jon Barnwell. Also, Barnwell will rule on whether Wiggins personnel file may be turned over to Moore.
