NOTICE OF SALE

WHEREAS, on November 23, 2009, Loretta Kaye Jackson and Taurean Tramayne Wise executed a Deed of Trust to Michael L. Riddle, as Trustee for FBT Mortgage, LLC, as Lender, with Mortgage Electronic Registration Systems, Inc., (“MERS”), as Beneficiary, which is recorded in the office of the Chancery Clerk of Leflore County, MS, in Book 0707 at Page 116;

WHEREAS, said Deed of Trust was assigned to Trustmark National Bank in Book 861 at Page 434;

WHEREAS, on March 29, 2019, Trustmark National Bank substituted James Eldred Renfroe as Trustee in the aforementioned deed of trust with this recorded in Book 861 at Page 436;

WHEREAS, there being a default in the terms and conditions of the Deed of Trust and entire debt secured having been declared to be due and payable in accordance with its terms, Trustmark National Bank, the holder of the debt has requested the Trustee to execute the trust and sell said land and property pursuant to its terms in order to raise the sums due, with attorney’s and trustee’s fees, and expenses of sale;

NOW, THEREFORE, I, James Eldred Renfroe, Trustee for said Deed of Trust, will on May 29, 2019, offer for sale at public outcry, and sell within legal hours (being between the hours of 11:00 a.m., and 4:00 p.m.) at the south main door of the Leflore County Courthouse in Greenwood, MS, to the highest and best bidder for cash, the following described property situated in Leflore County, MS, to-wit:

Lot 26, Blue Lake Addition No. 1, a subdivision according to a map or plat thereof which is on file and of record in the office of the Chancery Clerk of Leflore County, Mississippi, in Plat Book 5 at Page 39, reference to which is hereby made in aid of and as part of this description.

You have been made a Defendant in the suit filed in this Court by Johnathan David Fedrick, Administrator of the Estate of Tommy Lee Fedrick, Plaintiff, seeking a determination of heirs-at-law of Tommy Lee Fedrick, Deceased.  You are summoned to appear and defend against the Complaint or Petition filed against you in this action at 9:45 a.m. on the 14th day of June, 2019, in the Courtroom of the Honorable W.M. GREENWOOD PLANNING COMMISSION

There will be a hearing before the Greenwood Panning Commission for review of the request for approval of a conditional use as listed below:

1. Mr. Maurice Harris, representing owner, Van Hoover, request approval for a conditional use in the C-2, Community Commercial District, to allow for a cocktail and social lounge located at 511 George Street, Greenwood, Mississippi.   Legal Description:   Part of Lots 7 and 10 in Block 24 of the Douglas Addition, Greenwood, Leflore Co., MS (Parcel#:  085-1004-37-006.00)

The hearing will be held on Thursday, May 23, 2019, at 4:30 p.m. in the City Hall Conference Room.  Anyone wishing to voice an opinion regarding the above request is urged to attend.
