WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated September 25, 2006, executed by RICHARD M. ROBERTS, Jr., MARY G. ROBERTS, conveying certain real property therein described to H. DONALD BROCK, JR., as Trustee, for MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR COATS AND COMPANY, INC., Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the office of the Chancery Clerk of Leflore County, Mississippi filed and recorded September 29, 2006, in Deed Book 656, Page 44 ; and

WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to US Bank Trust National Association as trustee of the Chalet Series III Trust; and

WHEREAS, the undersigned, Rubin Lublin, LLC has been appointed as Substitute Trustee; and

SUBSTITUTED TRUSTEE’S NOTICE OF SALE

   WHEREAS, on October 2, 2003, K and M Auto Parts, Inc., a Mississippi Corporation, executed a Deed of Trust to Carl L. Gorday, as Trustee, for the use and benefit of AmSouth Bank, which Deed of Trust is recorded in D/T Book 597 at Page 566 in the land records of the Chancery Clerk of Leflore County, Mississippi; and

     WHEREAS, on January 26, 2007, Regions Bank, an Alabama banking corporation and successor by merger to AmSouth Bank, did assign said Deed of Trust to Citizens Bank and Savings Company by instruments recorded in D/T Book 666 at Page 375 and in D/T Book 699 at Page 240; and

    WHEREAS, on October 27, 2008, K&M Auto Parts, Inc. executed a Land Deed of Trust to B. Sean Akins, as Trustee, for the use and benefit of CB&S Bank Greenwood, filed for record in the Land Records located in the Office of the Chancery Clerk of Leflore County, Mississippi on November 7, 2008 in D/T Book 692 at Page 295; and

    WHEREAS, on December 7, 2011, K&M Auto Parts, Inc. executed a Land Deed of Trust to B. Sean Akins, as Trustee, for the use and benefit of CB&S Bank Greenwood, filed for record in the Land Records located in the Office of the Chancery Clerk of Leflore County, Mississippi on December 19, 2011 in D/T Book 735 at Page 1; and

  WHEREAS, on July 24, 2017, K&M Auto Parts, Inc. executed a certain Deed of Trust to B. Sean Akins, as Trustee for the use and benefit of CB&S Bank filed for record in the Land Records located in the Office of the Chancery Clerk of Leflore County, Mississippi, on August 9, 2017, in D/T Book 833, Page 487; and

    WHEREAS, Citizens Bank and Savings Company is the one and same entity as CB&S Bank and CB&S Bank Greenwood; and

    WHEREAS, default is continuing under the above described Deeds of Trust, and the undersigned, CB&S Bank, as current and present owner of said Deeds of Trust, has elected to declare the entire indebtedness secured by said Deeds of Trust due and payable as provided for therein; and

     WHEREAS, said Deeds of Trust authorized the appointment and substitution of another Trustee in the place of the Trustees named in said Deeds of Trust, and CB&S Bank, pursuant to said Deeds of Trust, substituted James P.
