SUBSTITUTED TRUSTEE'S NOTICE OF SALE

WHEREAS, on May 23, 2011, Marie Peoples, A Single Person executed a certain deed of trust to Michael L Riddle, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc as nominee for FBT Mortgage LLC which deed of trust is of record in the office of the Chancery Clerk of Leflore County, State of Mississippi in Book 0727 at Page 207; and

WHEREAS, JPMorgan Chase Bank, National Association has heretofore substituted Shapiro & Brown, LLC as Trustee by instrument dated October 17, 2019 and recorded in the aforesaid Chancery Clerk's Office in Book 0870 at Page 231; and

WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, JPMorgan Chase Bank, National Association, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.

NOW, THEREFORE, I, Shapiro & Brown, LLC, Substituted Trustee in said deed of trust, will on December 4, 2019 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the South Door of the County Courthouse of Leflore County, located at 310 West Market Street, Greenwood, MS 38930, to the highest and best bidder for cash  or certified funds the following described property situated in Leflore County, State of Mississippi, to-wit:

Lot Fourteen (14) of the Burns Estates Subdivision in Leflore County, Mississippi, as the same is shown upon the map of said subdivision recorded in Plat Book 5, at Page 20, of the Records of Maps on file in the office of the Chancery Clerk of Leflore County, Mississippi.

I WILL CONVEY only such title as vested in me as Substituted Trustee.

SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, Kenneth R. Beauvais, Chief Executive Officer for Hardware Distribution Warehouses, Inc., as Grantor, executed a certain Deed of Trust (the “Deed of Trust”) to Nathan Russell as Trustee for Capital One, National Association, Beneficiary, to be effective as of the 21st day of October, 2009, which Deed of Trust was filed of record on November 2, 2009, in Deed of Trust Book 0706 at Page 89, in the land records of the office of the Chancery Clerk of Leflore County, State of Mississippi; and  

WHEREAS, on October 25, 2019, the aforesaid Capital One, National Association substituted John T. Rouse as Trustee in and for the aforesaid Deed of Trust and the indebtedness secured thereby in lieu and in place of Nathan Russell, filed October 31, 2019 and recorded in the land records of the office of the Chancery Clerk of Leflore County, State of Mississippi in Book 0870 at Page 349; and

WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire indebtedness secured thereby having been declared to be due and payable, in accordance with the terms of said Deed of Trust, Capital One, National Association, the present legal holder of said Deed of Trust and the indebtedness secured thereby, having requested the undersigned Substitute Trustee to execute the trust and to sell said land, property, and all fixtures in accordance with the terms of said Deed of Trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, Substitute Trustee’s fees and expenses of sale.

Begin at the southernmost corner of lot 22 in Block Three of the said Greenwood-Leflore Industrial Park for a point of beginning of the tract herein described; from said point of beginning proceed north 30 degrees 20 minutes 30 seconds west for the distance of 90 feet to the point of tangency of a curve with a radius of 440 feet; thence proceed in a northwesterly direction along said curve for the distance of 44 feet to a point; thence proceed north 89 degrees 43 minutes 40 seconds east for a distance of 270 feet to a point; thence proceed south 59 degrees 39 minutes 30 seconds west for the distance of 234.13 feet to the point of beginning;

The above-described tract of land being situated in Leflore County, Mississippi, containing 0.361 acres, more or less, with all buildings and improvements thereon.

I WILL CONVEY only such title as is vested in me as Substitute Trustee.
