     WHEREAS, on March 10, 2015, Cedric Winchester and Geneva Childs Winchester, as husband and wife, executed a Deed of Trust to J. Mark Franklin, III, Trustee for the benefit of Liberty Bank and Trust Company, as recorded in the office of the Chancery Clerk of Leflore County, Mississippi, in Book 0792 at Page 365; and,

     WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Trustee to execute the Trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Trustee's fees and expenses of sale;

     NOW, THEREFORE, I, the undersigned J. Mark Franklin, III, being the Trustee, do hereby give notice that on August 29, 2019, between 11:00 o'clock a.m. and 4:00 o'clock p.m., being the legal hours of sale, I will proceed to sell at public outcry, to the highest bidder for cash, at the South Door of the Leflore County Courthouse in Greenwood, State of Mississippi, the following real property described and conveyed in said Deed of Trust, lying and being situated in Leflore County, Mississippi, and being more particularly described as follows, to-wit

Lots 169, 170, 171, 172, 173, 174, 175, 176, 177, 178 and 179 of Block Seventeen (17) of the Town of Itta Bena, and all that certain lot and parcel of land except Fifty (50') off the East end thereof, lying and being South of said Block 17 and North of Mississippi State Highway #7 (formerly known as East Lane Public Road) all as shown upon the map of said Town of Itta Bena recorded in Deed Book 14, at Page 254 of the Land Deed records of Leflore County, Mississippi.

Beginning at the Southeast corner of Lot One Hundred Eighty (180) in Block Seventeen (17) Town of Itta Bena, Leflore County, Mississippi, as shown by map recorded in Book 23 at Page 124 of the Land Deed records of Leflore County, Mississippi, run thence Westwardly along the Southern boundary line of said Lot 180 for a distance of Fifty (50') feet to the Southwest corner of said Lot 180; run thence Southwardly on a line which is an extension of the Western boundary line of said Lot 180, said line being also parallel to the Eastern boundary line of said Lot 180 to the Northern boundary line of said right-of-way to the Western boundary line of Allen Street; thence run Northwardly along said Western boundary line of said Allen Street to the point of beginning.

Lot 180 of Block 17 of the Town of Itta Bena, as shown upon the map or said Town of Itta Bena, recorded in Deed Book 14, at Page 264 of the Land Deed records of Leflore County, Mississippi.

SUBSTITUTED TRUSTEE’S FORECLOSURE NOTICE

   WHEREAS, on July 17, 2017, Wendell E. McCaleb executed a certain Deed of Trust to Mark S. Vemer, Trustee, for the benefit of Bank of Commerce, which Deed of Trust is of record in the office of the Chancery Clerk of Leflore County, Mississippi in Deed of Trust Book 832, at page 245 of the Records of Mortgages and Deed of Trust on Land; and

  WHEREAS, Bank of Commerce has heretofore substituted H. Donald Brock, Jr. as Trustee in place and in lieu of the present Trustee by instrument dated and recorded July 22, 2019, in Book 866 at page 182 of the office of the aforesaid Chancery Clerk; and

WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due in accordance with the terms thereof, Bank of Commerce, the legal holder of said indebtedness requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees, and expenses of sale.
