WHEREAS, on the 11th day of September, 2015, Lori L. McNeal, executed and delivered a certain Deed of Trust unto Todd Stiverson, Trustee for Mortgage Electronic Registration Systems, Inc. as nominee for New Penn Financial, LLC, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Leflore County, Mississippi in Mortgages & Deeds of Trust on Lands Book 802 at Page 55; and

 

WHEREAS, on the  30th day of November, 2018, Mortgage Electronic Registration Systems, Inc. , assigned said Deed of Trust unto New Residential Mortgage, LLC, by instrument recorded in the office of the aforesaid Chancery Clerk in Mortgages & Deeds of Trust on Lands Book 855  at Page 613; and  

 

WHEREAS, on the 30th day of September, 2019 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Deed of Trust Book 0869 at Page 574; and

 

WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 20th day of November, 2019, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the South front entrance (or door) of the Leflore County Courthouse at Greenwood, Mississippi, for cash to the highest bidder, the following described land and property situated in Leflore County, Mississippi, to-wit:

WHEREAS, on the 27th day of January, 2009, Machrell Antwine, executed and delivered a certain Deed of Trust unto ReconTrust Company, N.A., Trustee for Mortgage Electronic Registration Systems, Inc. as nominee for Countrywide Bank, FSB, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Leflore County, Mississippi in Mortgages & Deeds of Trust on Lands Book 696 at Page 65; and

 

WHEREAS, on the 21st day of November, 2018, the Holder of said Deed of Trust filed a Loan Modification Agreement of Deed of Trust by instrument recorded in the office of the aforesaid Chancery Clerk of Court in  Mortgages & Deeds of Trust on Lands Book 855  at Page 127; and

 

WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to PennyMac Loan Services, LLC by instrument recorded in the office of the aforesaid Chancery Clerk in Mortgages & Deeds of Trust on Lands Book 857 at Page 354; and  

   

WHEREAS, on the 29th day of June, 2017 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Deed of Trust Book 0834 at Page 424; and

 

WHEREAS, on the 2nd day of May, 2018, an Amended Order Granting Default Judgment and Final Judgment on the Pleadings was rendered in the matter styled Bank of America, N.A. vs. Machrell Antwine, et al., In the Chancery Court of Leflore County, Mississippi, Cause No. 17-cv-145 of the Chancery Court of Leflore County, Mississippi.  Said  Judgment confirms title to the Subject Property to Machrell Antwine, and the Deed of Trust, Assignment, Loan Modification Agreement, and Substitution of Trustee are reformed and revived to include the correct, complete and accurate legal description of the Subject Property. Said Judgment holds that Plaintiff has a valid, perfected, and enforceable first priority lien against the entire Subject  Property. Amended Order Granting Default Judgment and Final Judgment on the Pleadings appearing in the Leflore County Chancery Clerk's land records in Deed Book 465 at Page 489 on May 11, 2018; and
